Thanks to your growing support, the year is starting off well with a consultation meeting scheduled for January 7th between the organisations that signed our open letter and representatives of the Ministry of Economy and Finance, the General Directorate of Enterprises and the DGCCRF.
Yesterday, the U.S. Supreme Court let stand the 9th Circuit Court of Appeals’ decisionto uphold the City of Berkeley, California’s “Cell Phone Right-to-Know” law. This law requires mobile phone retailers to warn consumers at the point of sale that carrying mobile phones in pockets and bras could present radiation health risks.
So today, we’re asking you to send the sample municipal law (below) to your town, city or county elected officials. Let’s take advantage of this great 9th Circuit victory over the cell phone industry by enacting this same “Right-to-Know” law in thousands of communities across America. (Note: You must use the identical language contained in the City of Berkeley’s law printed below to fall within the 9th Circuit ruling.)
Kudos to Dr. Joel Moskowitz and Ellie Marks for spearheading this effort for a total of 10 years, and to Professor Lawrence Lessig who helped shape the legal arguments that beat the industry!
SAMPLE CELL PHONE RIGHT-TO-KNOW LAW
The (town, city or county) of ______________ requires that you be provided the following notice:
“To assure safety, the Federal Government requires that cell phones meet radio-frequency (RF) exposure guidelines. If you carry or use your phone in a pants or shirt pocket or tucked into a bra when the phone is ON and connected to a wireless network, you may exceed the federal safety guidelines for exposure to RF radiation.
“Refer to the instructions in your phone or user manual for information about how to use your phone safely.”

We warn against 3 mobile phones of the brands BlackBerry, Doro and Selecline. We ask the French public authorities to withdraw the RTTE versions from the market as soon as possible.
Precautions to be taken by the holders of electronic implants (cardiac pacemakers, insulin pumps, neurostimulators …) concerning in particular the distance between the radio equipment and the implant (15 centimeters in the case of the strongest sources of exposure like the mobile phones).
B. – Information on the behaviors to be adopted to reduce exposure to radiation emitted by radio equipment
. Use the radio equipment in good reception conditions to reduce the amount of radiation received.
. Use a hands-free kit or loudspeaker, if suitable for radio equipment.
. Make reasonable use of radio equipment such as mobile phones, by children and teenagers, for example by avoiding nocturnal calls and by limiting the frequency and duration of calls.
. Keep radio equipment away from pregnant women’s belly.
. Keep radio equipment away from the lower abdomen of teenagers.

Called upon in the context of the Phonegate industrial and health scandal by Léon Warnier, Swiss Phonegate Alert Coordinator, the Swiss Federal Office of Public Health (SFOPH) initially declared itself incompetent. After a cascading referral to different authorities, the FOPH claims to be unaware of which office is responsible for protecting the health of smartphone users!…
French ministerial announcements: an important step in our actions to protect the health of mobile phone users
In a joint statement published today, the French ministries of Health, Ecology and Economy announced several proposals for action to strengthen health protection for mobile phone users in France and Europe. These are in the context of the recommendations made on 21 October 2019 by the French health & safety agency in its report entitled “Mobile phones worn close to the body and health”, and the mobilization actions of our association following the revelation in July 2016 by Dr Marc Arazi of the Phonegate industrial and health scandal.
For our President:
“This is undoubtedly another victory for our association and for all the partner organisations, independent scientists, lawyers who are members of the Consortium, journalists who work in France and abroad to protect the health of the 5 billion mobile phone users”.
However, we regret the lack of consultation with the associations that are fighting this fight. We reiterate our call for a meeting with the ministers concerned. To this end, we will take an initiative in the coming days.
