2) What could be a precedent-setting lawsuit has been filed on behalf of a sensitive person who is not being protected or accommodated as required under the Americans with Disabilities Act. The results of this lawsuit, and others which are in the works, might help sensitive people in Canada. CHD Funds Lawsuit on Behalf of Man Who Says Verizon Cell Tower Triggered Life-Threatening Cardiac Events
“The lawsuit, filed today, could set an important legal precedent that would help people like Henry “Hank” Allen, who have electromagnetic sensitivity, fight back against cell towers being placed near their homes….
An Idaho man alleging the radiofrequency radiation emitted by a cell tower installed next to his home triggered more than 15 episodes of atrial fibrillation today sued Verizon and other companies involved in the operation of the tower.
Henry “Hank” Allen, age 53, said his electromagnetic sensitivity (EMS) makes him vulnerable to life-threatening cardiac episodes, which began in April 2021, when Verizon activated the tower.
The lawsuit, funded by Children’s Health Defense (CHD) and filed in the U.S. District Court for the District of Idaho Southern Division, could set an important legal precedent that would help others with EMS who want to fight back against having a cell tower placed near where they live.”
Canada’s Accessible Act reads as if it too could be challenged by sensitive people harmed by telecoms’ towers, transmitters and grids. I do not know if there has been a challenge to it on behalf of people with EHS but I will try to find out.

Subject: Update on Rogers Tower debacle
I hope this finds you cozy and nestling into the peace and restorative potential of the season.
It has been a while since I have sent news on the Channel Ridge tower “situation”. The tower has been up and running since July. In the meantime, since last spring, I have been supporting Julian with his judicial review application. It has been a blur of legalese, writing, revising, editing, reading the bullish and belittling words of Rogers’ attorney (of course he works for the largest law firm in the province), working to deadline, and realizing that we have a very strong case indeed.
We are now preparing for the oral submission Julian will present at a February 1st hearing with a Federal Court judge in Vancouver. The judge will then review all evidence and take several months most likely to come to a decision. Julian is a powerful speaker and I am confident that his presentation will be of titanium level strength. Based on provisions found in federal antenna siting regulations, our big ask is that this tower be removed.
How to Get Involved
1. On an energetic level, please visualize that a just, empathetic and non-telecom industry affiliated judge be given this case. I believe our case will sway any reasonable judge, and also believe a little light sent that way could help create a clearing in the muck so to speak that will support justice to prevail.
2. Attend the hearing. Please note this is not the place to protest. If you attend in person you are there to be a silent yet supportive witness. There is also an option to attend virtually. More on that below.

1. The Hearing
Date: Thursday, February 1, 2024
Where: Pacific Centre – 3rd Floor, 701 Georgia Street West, Vancouver
Time: Starts at 9:30am – until 4:30pm.
2. In person – you do not need to register in advance. However, you should leave time to get through security. And you must enter the gallery chambers when the hearing is not in session (so you have to be in your chair before 9:30am). You are not allowed to speak out or disturb the hearing – if you do, you will be removed.
3. On-line – you do have to register at least 24 hours in advance of the hearing. You can find the registration at the following link:
